By creating an account or using the Here application and companion software ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service.
Here provides software that allows users to simulate GPS coordinates on iOS devices for personal use. The Service consists of a web application, a downloadable Mac companion application, and a mobile progressive web app (PWA). The Service requires a Mac computer and a compatible iOS device.
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these terms.
You agree to provide accurate, current, and complete information during registration. You are responsible for safeguarding your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use of your account.
You agree to use the Service only for lawful purposes. You shall not use the Service to: (a) violate any applicable local, state, national, or international law; (b) commit fraud or deceive any person or entity; (c) stalk, harass, or harm another individual; (d) interfere with or circumvent law enforcement activities; (e) violate the terms of service of any third-party application or platform; (f) engage in any activity that could result in harm to others.
The Service offers a free tier with limited usage (2 teleports) and a paid subscription plan at $10.00 USD per month for unlimited usage. Paid subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. You may cancel at any time; cancellation takes effect at the end of the current billing period.
All purchases are final. No refunds will be issued for any reason, including but not limited to: partial month usage, dissatisfaction with the Service, inability to use the Service due to device incompatibility, or account termination for violation of these terms. We provide a free tier so users can evaluate the Service before subscribing.
All content, features, and functionality of the Service — including but not limited to software, text, graphics, logos, and design — are owned by Here and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE MAKE NO WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF THE RESULTS OBTAINED THROUGH THE SERVICE. Apple may update iOS in ways that affect the functionality of the Service at any time.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HERE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
You acknowledge that location spoofing may violate the terms of service of third-party applications and platforms. You assume all risks associated with your use of the Service, including any consequences from third-party platforms such as account suspension or bans. Here is not responsible for any actions taken against you by third parties as a result of your use of the Service.
We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. No refunds will be provided upon termination.
We may modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
